1. Acceptance of Terms

Welcome to Pathsie! By accessing or using the Pathsie mobile application ("App") and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App or Services.

These Terms constitute a legally binding agreement between you and Pathsie. We reserve the right to update these Terms at any time. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Pathsie is a social platform for outdoor enthusiasts that enables users to:

  • Connect with other outdoor activity enthusiasts
  • Plan and organize trips with groups
  • Record and share outdoor activity routes
  • Track locations and share safety information
  • Communicate through chat and messaging features
  • Share photos, videos, and trip experiences
  • Split and manage trip expenses
  • Access weather data and trip planning tools

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 13 years old to use Pathsie. If you are under 18, you must have parental or guardian consent to use the Services.

3.2 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current information
  • Immediately notifying us of any unauthorized access or security breach

3.3 One Account Per Person

Each user may maintain only one account. Creating multiple accounts or impersonating others is prohibited.

4. User Conduct and Responsibilities

4.1 Acceptable Use

You agree to use Pathsie in accordance with all applicable laws and regulations. You will NOT:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
  • Violate the rights of others, including privacy and intellectual property rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Upload viruses, malware, or any harmful code
  • Engage in spamming, phishing, or other fraudulent activities
  • Harass, bully, or intimidate other users
  • Collect or store personal data of other users without consent
  • Use automated systems (bots, scrapers) to access the Services
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers

4.2 Content Guidelines

When sharing content on Pathsie, you must:

  • Own the rights to the content or have permission to share it
  • Ensure content is appropriate for a general outdoor enthusiast audience
  • Respect the privacy of others (do not share personal information without consent)
  • Be truthful and accurate in trip descriptions and reviews
  • Not post sexually explicit, violent, or graphic content

4.3 Safety and Outdoor Activities

IMPORTANT: Outdoor activities involve inherent risks. You acknowledge that:

  • You are solely responsible for your safety during outdoor activities
  • Pathsie is a planning and coordination tool, not a safety guarantee
  • You must use appropriate equipment, training, and judgment for your activities
  • Weather data and route information is provided for reference only
  • You should verify all information and conditions before embarking on trips
  • Emergency features are supplementary tools and do not replace proper safety planning
  • You participate in outdoor activities at your own risk

5. Content Ownership and License

5.1 Your Content

You retain ownership of all content you post on Pathsie (photos, videos, routes, comments, etc.). However, by posting content, you grant Pathsie a worldwide, non-exclusive, royalty-free license to:

  • Use, reproduce, modify, and display your content within the Services
  • Share your content with other users based on your privacy settings
  • Use your content for promotional purposes (with your consent)
  • Store and back up your content on our servers

5.2 Pathsie's Content

The Pathsie App, including its design, features, code, and original content, is owned by Pathsie and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our written permission.

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without notice. You can delete your own content at any time through the App.

6. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy (available at pathsie.com/privacy) explains how we collect, use, and protect your personal information. By using Pathsie, you consent to our Privacy Policy.

You are responsible for respecting the privacy of other users. Do not share others' personal information without their explicit consent.

7. Fees and Payments

7.1 Beta Access

Pathsie is currently in beta testing and free to use. All features are unlocked for beta testers.

7.2 Future Premium Features

We may introduce premium features or subscription plans in the future. We will provide advance notice of any pricing changes. Beta testers may receive special pricing or benefits.

7.3 In-App Purchases

Any future in-app purchases will be processed through the Apple App Store or Google Play Store. Their respective terms and refund policies will apply.

8. Third-Party Services and Links

Pathsie integrates with third-party services including:

  • Mapping and location services
  • Weather data providers
  • Cloud storage services
  • Authentication providers (Sign in with Apple, Google, etc.)

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is subject to their own terms and policies.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

Pathsie is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

9.2 Outdoor Activity Risks

PATHSIE IS NOT RESPONSIBLE FOR YOUR SAFETY DURING OUTDOOR ACTIVITIES. You acknowledge that:

  • Outdoor activities involve inherent risks including injury or death
  • Route data, weather information, and trip details may be inaccurate or outdated
  • Other users' information and recommendations may not be reliable
  • Emergency features are not a substitute for proper safety equipment and planning
  • You are solely responsible for your decisions and safety

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHSIE SHALL NOT BE LIABLE FOR:

  • Personal injury, death, or property damage arising from outdoor activities
  • Errors, inaccuracies, or omissions in route data, weather information, or user content
  • Unauthorized access to or alteration of your data
  • Actions or conduct of other users
  • Loss of data, revenue, or profits
  • Any indirect, incidental, special, consequential, or punitive damages

Our total liability to you for all claims shall not exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater).

9.4 User Responsibility

You are responsible for:

  • Verifying the accuracy of all information before relying on it
  • Obtaining appropriate permits, insurance, and training for outdoor activities
  • Using proper safety equipment and following best practices
  • Making your own risk assessments and safety decisions
  • Understanding and accepting the risks of outdoor activities

10. Indemnification

You agree to indemnify, defend, and hold harmless Pathsie, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you post on Pathsie
  • Your outdoor activities and adventures

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the App settings or by contacting us at support@pathsie.com.

11.2 Termination by Pathsie

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or other government agencies
  • Technical or security issues

11.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We may delete your account data, though some information may be retained as required by law or for legitimate business purposes.

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute with Pathsie, please contact us at legal@pathsie.com to attempt to resolve it informally before pursuing legal action.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

12.3 Arbitration

Any disputes arising from these Terms or your use of Pathsie shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits.

13. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pathsie.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
